Terms & Conditions

These Terms & Conditions explain the rules for using this website and engaging Idea Cresta for professional digital services.

Effective date: September 14, 2026

1. Acceptance of These Terms

By accessing the Idea Cresta website, requesting a quotation, approving a proposal, making a payment or using our services, you agree to these Terms & Conditions. If you are acting for a company or another organization, you confirm that you have authority to accept these terms on its behalf. If you do not agree, do not use the website or purchase services.

2. About Our Services

Idea Cresta provides services that may include search engine optimization, digital marketing, web design and development, custom software development, mobile application development, consulting, maintenance and related support. Website descriptions are general information and do not create a binding scope, schedule or price.

The specific deliverables, responsibilities, fees, milestones and assumptions for a project will be stated in a written quotation, proposal, statement of work, order or other agreement accepted by both parties. If a project document conflicts with these website terms, the project document controls for that project.

3. Quotations and Project Approval

Unless a quotation states otherwise, pricing is based on the information available when it is prepared. A quotation may expire on the date stated in it. Work begins only after required approvals, information and payment have been received.

Requests outside the approved scope may require a revised quotation, additional fees and a changed delivery schedule. Estimates are not guarantees when project requirements, third-party dependencies or client inputs change.

4. Client Responsibilities

You agree to provide accurate information, timely feedback, lawful content and the access reasonably needed to perform the services. You are responsible for reviewing deliverables and identifying corrections within any review period stated in the project agreement.

You confirm that you have the rights and permissions necessary for all text, images, trademarks, data, software, credentials and other materials you provide. You must not ask us to create, publish or process unlawful, infringing, deceptive or harmful material.

5. Fees, Invoices and Taxes

Fees and payment schedules are stated in the applicable quotation or invoice. Payments must be made using an approved method and in the stated currency. You are responsible for applicable taxes, bank charges or transaction fees unless the project agreement says otherwise.

We may pause work, access or delivery when an invoice is overdue. A pause caused by late payment or missing client input may change the delivery schedule.

6. Refunds and Cancellations

Payments are final and non-refundable as explained in our Payment and Refund Policy. Because resources are reserved and work may begin immediately, cancellation does not create a right to a full or partial refund. Any rights that cannot legally be excluded remain unaffected.

7. Intellectual Property

Each party retains ownership of materials, methods, software, trademarks and other intellectual property it owned before the project. Unless the project agreement states otherwise, ownership of final custom deliverables specifically created for you transfers only after all related invoices are paid in full.

Idea Cresta retains ownership of reusable tools, frameworks, libraries, processes, know-how, templates and pre-existing components. Third-party assets and software remain governed by their own licenses. You are responsible for maintaining licenses that must remain in your name.

8. Third-Party Services

Projects may use third-party platforms such as hosting providers, advertising networks, analytics tools, application stores, payment services, content systems or APIs. Their availability, pricing, review decisions and policies are outside our control. You are responsible for complying with the terms of accounts owned by you.

9. Confidentiality

Each party will use reasonable care to protect non-public business information received for a project and will use it only for the engagement, except where disclosure is authorized or required by law. Information that is public, independently developed or lawfully received from another source is not confidential.

10. Results and Warranties

We aim to provide services with reasonable professional care. However, business, advertising, search-ranking, traffic, revenue, approval and marketplace results depend on many factors outside our control. We do not guarantee specific rankings, lead volumes, sales, platform approvals or uninterrupted third-party services.

To the fullest extent permitted by law, the website and services are provided without implied warranties beyond those expressly stated in an accepted project agreement.

11. Limitation of Liability

To the fullest extent permitted by law, Idea Cresta will not be liable for indirect, incidental, special, punitive or consequential losses, including lost profits, lost data or lost business opportunities. Our total liability arising from a particular project will not exceed the fees paid to Idea Cresta for the part of the services giving rise to the claim during the six months before the event.

12. Suspension and Termination

We may suspend or terminate services for non-payment, unlawful instructions, security risk, abuse, material breach or prolonged failure to provide required information. Provisions concerning payment, ownership, confidentiality, disclaimers, liability and dispute resolution survive termination.

13. Website Use

You may use this website for lawful business information and enquiries. You must not attempt unauthorized access, introduce malicious code, interfere with website operation, scrape the website abusively or misrepresent your identity.

14. Governing Law

These terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. Before starting formal proceedings, the parties agree to make a reasonable effort to resolve a dispute through good-faith discussion.

15. Changes to These Terms

We may update these terms to reflect changes in our services, operations or legal obligations. The effective date at the top identifies the latest version. Changes apply from publication unless a different date is stated.
